GTC
General Terms and Conditions
Scope of Application
These General Terms and Conditions (GTC) apply to the use, all business transactions, and any legal acts conducted via this website, as well as in written, verbal, or telephone contact. The GTC apply to all coaching and further education services offered by the provider, both domestically and internationally, for all clients (hereinafter referred to as "clients") and for the entire duration of the business relationship. By using the provider's services, the clients accept these GTC. Any changes, adjustments, or side agreements require prior written consent between the client and the provider to be valid. Changes to these GTC are reserved, and the version published on this website applies. Swiss law is applicable, and the place of jurisdiction is Zurich.
Offer, Use, Registration, and Conclusion of Contract
The provider offers coaching, workshops, as well as training and further education in the areas listed on this website in the form of individual or group sessions, lectures, or online courses and publications for a fee. This offer on the website or in any other written or verbal form is merely an invitation to submit an offer for the use of the services offered by the clients. This offer can be made online via the website, by email, or by telephone. A contract is concluded only when the provider formally accepts and confirms the offer—either in writing or via the online order system—and obligates the clients to timely pay all costs. In the case of a specially agreed order scope, detailed conditions will be recorded in a written agreement between the provider and the clients, confirmed by the provider. The provider explicitly reserves the right to refuse to enter into a collaboration or to terminate it without providing a reason.
Clients’ Duty to Cooperate
The coaching, further education, and transformation services offered by the provider are normally based on framework conditions and guidelines mutually agreed upon between the provider and the clients. The cooperation between the provider and the clients is based on collaboration and mutual trust. It is explicitly noted that coaching, as distinct from consulting, is an active, voluntary, and self-responsible process, and predetermined successes are not guaranteed. The coach supports and accompanies the clients on their journey towards growth and transformation and assists them with questions, decisions, and changes. However, the actual work of transformation is done by the clients, who are responsible for being open and ready for change during the process.
Organization, Implementation, Rescheduling, and Cancellation
The organization and implementation of the agreed services take place according to the prior agreement between the clients and the provider, as described above in the contract conclusion process. The provider reserves the right to reschedule the service for organizational reasons, change the location of the service, or modify the content and organization for didactic reasons. To ensure optimal conditions for group courses, the provider also reserves the right to set a minimum and maximum number of participants for each such offering. If the number of participants is insufficient, the course is usually canceled. In such cases, the clients will be informed by the provider within an appropriate timeframe. In the case of force majeure, unforeseeable events, or the provider's absence due to accidents or illness, an alternative date will be proposed, and a new date will be mutually agreed upon. In the case of cancellation or non-performance by the provider, costs will be waived or refunded.
Cancellations by the clients must be made in writing or, if made by phone, confirmed in writing by the provider. Cancellations for an individual appointment can be made free of charge up to 2 working days before the scheduled date. After this, the full fee will be charged. Cancellations for a group appointment can be made free of charge up to 7 working days before the scheduled date. However, in every case, the preparation costs for the group appointment remain payable. Cancellations for a lecture or event can be made free of charge up to 14 working days before the scheduled date. However, in every case, the costs for the preparation of the lecture or event and any third-party costs (e.g., venue costs, additional services, third-party contracts, etc.) remain payable.
Prices and Payment Terms
The scope of the order, conditions, and specifications for the respective service are agreed upon in advance between the provider and the clients. Hourly rates vary depending on the effort and type of coaching (e.g., individual or group session, location, content of the service, etc.) between 450 and 750 CHF per hour. Daily rates vary depending on the task and type of coaching. For lectures, events, seminars, workshops, and other services, the provider will submit a customized, binding offer. Additional expenses, such as travel costs or out-of-pocket expenses, will be billed separately. Online services and online publications are listed on the website with their respective binding prices and processed through the online ordering systems. For all other services, the client agrees to pay the specified amount into the account listed on the invoice within 30 calendar days of receiving the invoice.
Confidentiality and Copyright
Both the provider and the clients agree to confidentiality and non-disclosure of any business or private matters that become known to them during their cooperation, even after the business relationship ends.
All content from the provider's conducted appointments, events, lectures, workshops, seminars, as well as all content presented on this website, is the intellectual property of the provider and is subject to copyright. Any further use is prohibited without the prior written consent of the provider in each individual case.
Insurance and Liability Disclaimer
The organizer of coaching, lectures, events, seminars, workshops, etc., is always the client. Participants therefore do not have insurance coverage through the provider. Insurance is the responsibility of the clients. Additionally, the purchase of cancellation insurance is recommended.
The provider’s services are purely service-based, and no specific results are owed. The provider’s liability is excluded, as are any claims for damages by the clients. The transmission of any data, including electronic transmission, is at the client’s own risk. For further information, please consult the additional liability disclaimer information on this website.
Final Provisions
Should any individual provisions of these General Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall not be affected.
